Is your Trust Funded Correctly?

A Trust is only as valuable as the assets that are in the Trust.  If a trust is not funded, it does not give the benefit of helping the estate avoid probate.  That does not mean every asset must be placed in the trust.  Working with an estate attorney (not an online service or a family/criminal lawyer that also does wills and trusts) will help your estate maximize the benefits of the Trust.  The Attorney will help you decide which assets shall be titled in the Trust and what assets we can use beneficiary (or transfer on death) assignments either to individuals or to the Trust.   Remember Wills go through probate but there are many techniques that can help your estate avoid probate:  Transfer on Death, Beneficiaries, Trust, etc.  Just because you have a trust does not mean your estate avoids probate. Make sure your assets are reviewed to determine the best possible way to transfer such assets.
